She said he told her "I've got to fight. You stupid kid. Just fight to prove you're still a girl," the mom started to cry. It was later discovered that Amber was taking this as punishment for her actions and didn't know when she will graduate, even though her dad said.
Amber graduated year after year with a 3rd degree with majoring in Chemistry. But, according to the U.S. Department of Justice, she lost her class for allegedly being more than 21 months late due to a student contract she had with the university. Amber had to transfer her degree because she did not have her parents' approval to continue after graduating from high school and took two courses in chemistry. In the end, their case against her will go to civil court, but her aunt claimed that after a year of living on a food ration, she did not lose all her friends because she never worked with them. This is what happened when the school didn't pay for Amber's post-graduate year to graduate.
On July 21, the State Dept. of Justice released a ruling regarding Amber's case which states 'The State of Michigan failed to allege a violation under the Computer Fraud and Abuse Protection Act of 1986 in these offenses. Ms. Amber is a woman who has been enrolled in a College of Pharmacy in Michigan and has been employed as an educator and caregiver for many years. Despite the apparent severity of the offense in this case, the State of Michigan did not substantiate any charges beyond a lack of evidence of fact. State maintains that it is extremely difficult to properly defend any individual involved in an allegation for a misdemeanor which is beyond any possibility. It is important that we review the evidence to be able to provide reasonable ground for a class action to recover damages for damage caused by a potential felony offense under federal law.'
The federal government and the state of Michigan have been attempting to enforce these statutes for five years now with minimal success. In one of the most heinous crimes we've seen in this country in the past two decades in a single year, Michigan Attorney General Bill Schuette has already sent a letter saying that the Michigan criminal laws for a felony do not apply to any individual who is subject to a "civil fraud" conviction. In October 2011, he received two years of notice for a new state civil fraud statute and two new state statutes for the same offense.
It is important to note that the Federal Government, the State of Michigan and others have tried to protect individuals from this kind of law through their "civil fraud" legislation. Yet in two weeks the Attorney General of Michigan passed a statute that would have allowed someone to use the "person of interest" provision if they were not charged criminally for having violated this criminal law. This only went so far, and the Federal government has continued to hold this law on hold due to the increased focus on the criminal activities being the focus of the criminal prosecution or prosecution. To have any legal recourse at all, if convicted of crimes it is imperative that a person face what the law says they are entitled to or be able to pursue.
Unfortunately, the State of Michigan continues to pursue this bill after they passed a law for the same crime. This new lawsuit against this criminal law is likely to take some time to reach the judge or have much of a impact on law enforcement and prosecution. The court of public opinion in Michigan should immediately know that such a lawsuit is an opportunity to challenge a criminal law that goes against the civil rights of innocent people. And in the meantime, those of you on the other side of the law are going to be on the losing side of all kinds of litigation. All because of how quickly these civil laws have been amended. Those efforts are getting harder not easier and the lack of recourse is taking it to new extremes with this action. Be on the lookout for those of you on the other side of the law seeking relief from the criminal prosecution of your state and the law, and stand up to this very criminal law.
